Terms of Service

The rules of using InstaGuide

Effective: May 15, 2026Updated: May 15, 2026

1. Acceptance of Terms

These Terms of Service (“$1”) govern your access to and use of the InstaGuide platform, including our web application, Chrome Extension, desktop application, and API (collectively, the “$1”) operated by InstaGuide (“$1” “$1” or “$1”).

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and “$1” refers to both you individually and the organization.

2. Description of Service

InstaGuide is a documentation automation platform that captures user interactions and uses AI to generate step-by-step guides. The Service includes:

  • Chrome Extension — Captures browser-based workflows during active recording sessions
  • Desktop Application — Captures interactions across any application during active recording
  • Web Dashboard — Manages, edits, shares, and exports guides
  • API — Programmatic access for enterprise integrations (subject to plan eligibility)
  • AI-Generated Descriptions — Step descriptions generated by third-party AI providers (Claude, Azure OpenAI, Google Gemini, Snowflake Cortex)

We may, at our discretion, add, modify, or discontinue features, products, or services. We will provide reasonable notice of material changes that adversely affect paid subscribers.

3. Eligibility & Account Registration

Age Requirement

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. The Service is not intended for users under 13.

Account Information

To use the Service, you must create an account by providing accurate, current, and complete information, including a valid email address. You agree to keep your account information up to date.

Account Approval

New accounts require administrator approval before they can be activated. We reserve the right to refuse, suspend, or terminate accounts at our discretion, particularly for accounts that violate these Terms.

One Account Per Person

You may not create multiple accounts to circumvent plan limits or evade enforcement actions.

4. Account Security & Two-Factor Authentication

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Mandatory Two-Factor Authentication

All accounts are required to enable Time-based One-Time Password (TOTP) two-factor authentication during initial setup. You must use an authenticator app of your choice (e.g., Google Authenticator, Authy, 1Password). Backup codes are issued at enrollment and must be stored securely — they are the only recovery method if you lose access to your authenticator device.

Password Requirements

Passwords must be at least 8 characters. We securely hash passwords using industry-standard algorithms and never store them in plain text.

Notification of Unauthorized Access

You must notify us immediately at [email protected] of any unauthorized use or suspected compromise of your account.

Account recovery: Personal account holders can use self-service email recovery if they lose their 2FA device. Organization members must request 2FA reset from their organization owner or administrator. We cannot bypass 2FA on your behalf without verified administrative authority.

5. Subscription Plans & Billing

The Service is offered under several subscription plans. Current plan features, guide limits, and pricing are described on our Pricing page.

Billing Provider

All paid subscriptions are processed by Stripe, Inc., our payment processor. By subscribing, you also agree to Stripe's terms of service. We do not store full payment card details on our servers.

Billing Cycle

Subscriptions are billed monthly or annually based on the cycle you select at checkout. Charges are automatically renewed on the same date each cycle until canceled.

Plan Tiers

PlanTypeBilling
FreePersonal$0 / no card required
StarterPersonalMonthly or annual via Stripe
ProPersonalMonthly or annual via Stripe
EnterpriseOrganizationBuilder + Viewer per-seat licensing, contract-based

Price Changes

We may change prices for any plan with at least 30 days' notice. Existing subscribers will be billed at the previous price until their current term ends, then renew at the new price unless they cancel.

Taxes

Prices displayed do not include applicable taxes (sales tax, VAT, GST). You are responsible for any taxes assessed in your jurisdiction.

6. Free Plan & Trial Terms

Free Plan

The Free plan allows creation of up to 10 guides forever (lifetime cap) with up to 15 steps per guide, with no credit card required. It includes step titles, descriptions, and guide summaries written by Insta, an auto-correction & review pass, and access to the Chrome Extension. PDF and HTML export, voice narration, Visual Process Flow, change tracking, and guide sharing all require a paid plan (Starter, Pro, Business). Custom branding, SSO, BYO cloud storage, BYO AI provider, and public iframe embed are Enterprise-only.

Free Plan Fair-Use

The Free plan is intended for individual users evaluating the Service. We reserve the right to suspend Free plan accounts that exhibit abusive patterns, including but not limited to: creating multiple accounts to exceed limits, automated scraping, or using the Service to compete with InstaGuide.

Trials

Every new personal account automatically starts a 15-day Pro trial with no credit card required. Every new organization account automatically starts a 30-day Business trial, also without a credit card. During the trial you have full access to the trialed plan's features (organization trials waive the 5-user minimum during the trial window). If you do not upgrade to a paid plan before the trial ends, your account moves to the Free plan automatically; you will not be charged.

7. Cancellation & Refunds

Cancellation

You may cancel your subscription at any time through the in-app billing portal (powered by Stripe). Cancellation takes effect at the end of your current billing period — you retain access to paid features until that date. We do not prorate or refund partial-period cancellations.

Refunds

All sales are final and non-refundable, except as required by applicable law. We may, at our sole discretion, issue refunds in cases of duplicate billing, service unavailability for extended periods, or other extenuating circumstances.

Failed Payments

If a renewal payment fails, your account will be downgraded to the Free plan after a grace period. Guides created above the Free plan limit will remain readable but cannot be modified until you restore a paid plan.

Termination by InstaGuide

If we terminate your account for violation of these Terms (see Section 14), no refund is owed.

8. Your Content & Ownership

You retain all rights, title, and interest in the guides, screenshots, annotations, voice transcripts, and other content you create using the Service (“$1”).

License to InstaGuide

You grant InstaGuide a worldwide, non-exclusive, royalty-free license to host, store, process, and transmit Your Content solely as necessary to provide the Service to you (and, if applicable, your organization). This license terminates when you delete Your Content or close your account, except where retention is required by law.

Your Responsibility for Your Content

You represent that you have all necessary rights and permissions to capture, store, and share Your Content. You are solely responsible for the legality and appropriateness of Your Content. We do not pre-screen captured content.

Confidential or Sensitive Information

Screenshots may inadvertently capture sensitive information visible on your screen. You are responsible for redacting (using our built-in blur tool), deleting, or otherwise handling any sensitive captures. We strongly recommend closing unrelated applications and notifications before recording.

9. Captured Content

The Chrome Extension and Desktop Application capture data only during active recording sessions you initiate. Captured data may include screenshots, click coordinates, keyboard events, scroll events, page URLs (with query parameters stripped), and optional voice narration.

For full details on what is captured, how it is processed, and our AI provider relationships, see our Privacy Policy, Section 2.

Important: By recording, you confirm that you have legal authority to capture the content on your screen, including any third-party software UIs, internal company tools, or information visible at the time of capture. If you are recording on behalf of an organization, you are responsible for complying with that organization's policies on screen capture and AI processing.

10. Acceptable Use Policy

You agree NOT to use the Service to:

  • Violate any applicable law, regulation, or third-party right
  • Capture content for which you do not have authorization (including, but not limited to, content covered by trade secret, copyright, or confidentiality obligations of others)
  • Capture or transmit material that is unlawful, defamatory, obscene, harassing, or otherwise objectionable
  • Reverse-engineer, decompile, or attempt to extract source code from the Service
  • Bypass, disable, or circumvent any security or access controls
  • Use the Service to develop or train a competing product
  • Scrape, crawl, or use automated means to access the Service beyond the documented API
  • Use the Service to send unsolicited communications or spam
  • Interfere with or disrupt the Service's infrastructure
  • Use the Service in connection with malware, ransomware, or other malicious software
  • Use the Service to capture material concerning illegal activities, child exploitation, or violations of human rights
  • Impersonate any person or entity, or misrepresent your affiliation
  • Create multiple accounts to evade plan limits, suspensions, or terminations

Violations may result in immediate suspension or termination of your account without refund.

11. AI Services & Disclaimers

InstaGuide uses third-party AI providers (currently Anthropic Claude, Microsoft Azure OpenAI, Google Gemini, and Snowflake Cortex) to generate step descriptions, workflow summaries, and other content from your captured screenshots.

AI Output Disclaimer

Organization administrators may select which AI provider processes their organization's captures. We use API tiers that do not use your data for model training.

14. Termination

Termination by You

You may terminate your account at any time by canceling your subscription and deleting your account from the dashboard. Upon deletion, all your personal data, guides, and content are permanently removed.

Termination by Us

We may suspend or terminate your access immediately, with or without notice, if:

  • You violate these Terms or our Acceptable Use Policy

  • You misuse the Service in a way that risks harm to us, other users, or third parties
  • Required by law, regulation, or governmental order
  • We discontinue the Service (we will give reasonable notice and refund any prepaid unused amounts)

Effect of Termination

Upon termination, your right to access the Service ends. Sections of these Terms that by their nature should survive termination will survive (e.g., intellectual property, liability, indemnification, governing law).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain damages. In those jurisdictions, the above exclusions and limitations apply only to the extent permitted by applicable law.

If you do not agree to the updated Terms, you must stop using the Service before the effective date.

The arbitration will be held in Delaware (or another mutually agreed location), in English, and judgment on the arbitration award may be entered in any court of competent jurisdiction.

Exceptions

Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property or confidential information. Small-claims court actions are also exempt from arbitration where permitted by law.

These Terms, together with our Privacy Policy and any plan-specific terms (e.g., Enterprise contracts), constitute the entire agreement between you and InstaGuide regarding the Service and supersede all prior agreements.
